Legal
Terms & Conditions
The terms on which you may use this website, and the limits of what anything on it commits either of us to.
1. Agreement to these terms
This website is operated by Openecore Private Limited (“openecore”, “we”, “us”). By accessing or using it you agree to these terms. If you do not agree with them, please do not use the website.
We may revise these terms from time to time. The version in force is the one published here on the date you use the website, and the date at the top of this page shows when it was last changed.
2. Using this website
You may view, browse and print pages from this website for your own use, and for the purpose of evaluating whether to work with us.
You agree not to:
- Use the website for any unlawful purpose, or in any way that breaches applicable law
- Attempt to gain unauthorised access to the website, its hosting infrastructure, or any system or network connected to it
- Introduce malware, or otherwise attempt to interfere with the proper working of the website
- Place an unreasonable load on the website, including by automated scraping, bulk downloading or denial-of-service activity
- Remove, obscure or alter any copyright, trade mark or other proprietary notice
- Reproduce, republish or redistribute substantial parts of the website’s content without our written permission
- Use the enquiry form to send unsolicited advertising, spam, or content that is unlawful, deceptive, defamatory or infringing
We may restrict or withdraw access to the website, in whole or in part, from anyone who breaches these terms.
3. Intellectual property
Unless stated otherwise, all content on this website — including the text, the layout and visual design, the openecore name and wordmark, the artwork, and the underlying code — is owned by us or licensed to us, and is protected by intellectual property law.
Nothing on this website transfers any right in that material to you, and no licence is granted beyond the limited use described in section 2. The openecore name and wordmark may not be used without our written permission.
Third-party names or technologies referred to on this website, including the technologies listed on our technology page, remain the property of their respective owners. Referring to a technology does not imply any endorsement, partnership or affiliation in either direction.
4. Open-source components
This website uses open-source software and typefaces under their respective licences. The Inter and JetBrains Mono typefaces are used under the SIL Open Font License 1.1. Those licences continue to govern those components, and nothing in these terms restricts rights you have under them.
5. The content is informational
The content on this website is provided for general information about what we do. It is not technical, legal, financial or professional advice, and you should not act on it without taking advice appropriate to your own circumstances.
We try to keep the website accurate and current, but we do not warrant that it is complete, accurate or up to date, and we are not obliged to update it.
6. Our work page is illustrative
Our work page describes the systems we engineer. It is written in the present tense and deliberately so: the entries illustrate the kind of engineering we do, and none of them names a client or is presented as a completed client project.
Nothing on this website should be read as a claim that a particular system has already been delivered, as a representation about any client, or as a guarantee of any result, timescale or cost. No client is named anywhere on this website.
Nothing on this website is an offer capable of acceptance, and no contract for services arises from your use of it. Any engagement between us would be governed by a separate written agreement setting out the scope, deliverables, timescales, fees, intellectual property and liability terms that apply to that work. Where such an agreement conflicts with these terms, that agreement prevails in respect of the work it covers.
7. Enquiries and confidentiality
Please read this section before sending us an idea.
Information you send us through the enquiry form or by email is not treated as confidential, and no confidentiality obligation or non-disclosure agreement arises simply because you sent it. Do not send us anything you regard as a trade secret, or any confidential or proprietary material, until a written confidentiality agreement is in place. We are glad to put one in place — just ask us first.
We may work on projects that are similar to, or that compete with, an idea you describe to us. Sending us an enquiry does not restrict what we may work on, and does not entitle you to any payment or interest in anything we develop independently.
You retain ownership of what you send us. You grant us permission to read it, store it and use it for the purpose of assessing and responding to your enquiry, and for nothing else. How we handle personal information in an enquiry is described in our Privacy Policy.
8. Career submissions
If you write to us about working with us, you confirm that the information you provide is accurate and that you are entitled to share it. Unsolicited candidate submissions from recruitment agencies are not accepted and create no obligation to pay a fee.
9. Availability and changes
We aim to keep the website available, but we do not guarantee that it will be uninterrupted or error-free. We may change, suspend or withdraw the website or any part of it at any time without notice, and we are not liable to you for doing so.
10. Links to other sites
Where this website links to a site we do not control, the link is provided for convenience only. We do not endorse those sites and are not responsible for their content, their availability or their practices. You follow such links at your own risk.
11. Disclaimer of warranties
To the fullest extent permitted by law, this website and its content are provided “as is” and “as available”, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
12. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, business, goodwill, anticipated saving or data, arising out of or in connection with your use of this website, whether in contract, tort including negligence, or otherwise.
Subject to the paragraph above and to section 11, our total liability arising out of or in connection with your use of this website is limited to the greater of the amount you have paid us in connection with this website, which will normally be nothing, or the minimum amount permitted by applicable law.
This section concerns the website only. Liability in respect of services we perform under a signed engagement is governed by that agreement.
13. Indemnity
You agree to indemnify us against any claim, loss, liability or reasonable cost arising from your breach of these terms, or from your unlawful or unauthorised use of this website.
14. Governing law and jurisdiction
These terms, and any dispute or claim arising out of or in connection with them or with your use of this website, are governed by the laws of India, without regard to conflict-of-laws principles.
You and we agree that the courts of Bengaluru, Karnataka have exclusive jurisdiction to settle any such dispute or claim, save that we may seek injunctive relief in any jurisdiction where it is necessary to protect our rights.
15. General
If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force and the unenforceable provision is treated as modified only so far as necessary to make it enforceable.
A failure or delay by us in enforcing any provision is not a waiver of it. You may not assign or transfer your rights under these terms. We may assign ours in connection with a reorganisation, merger or acquisition of our business.
These terms, together with our Privacy Policy, are the entire agreement between you and us regarding your use of this website, and supersede any earlier understanding about it.
